Draft notice: These Terms of Use are a pre-release draft. They have not been reviewed or approved by external legal counsel. The governing-law and venue provisions (Section 15) are pending final legal review before public deployment. All other sections reflect the current intended policy of the platform.

1. What Aether Is

Aether is a civic question engine that helps users explore public claims through structured evidence, analytical scoring, and transparent reasoning. Aether provides educational and informational outputs — not legal, professional, financial, or authoritative conclusions of any kind. Civic analysis is generated using the Anthropic Claude API; see the Privacy Policy for details on how claim text is processed.

Aether outputs are AI-assisted analytical summaries based on publicly available information. They may contain errors, omissions, or outdated information. They are not a substitute for independent research or professional advice.

2. Acceptance of Terms

By accessing or using Aether, you agree to be bound by these Terms of Use and the Privacy Policy. If you do not agree, you may not use the platform. Your continued use of the platform after any material update to these Terms constitutes acceptance of the revised Terms.

3. Eligibility

Aether is intended for users aged 13 and older. By using the platform, you represent that you are at least 13 years of age and that, if you are between 13 and 18, you have obtained parental or guardian consent where required by applicable law. Aether does not knowingly permit use by children under 13.

4. Permitted Use

You may use Aether for personal, non-commercial civic research and analysis. You may share Aether outputs for educational, informational, and journalistic purposes, provided you clearly identify them as AI-assisted summaries and do not misrepresent them as authoritative or verified findings.

Aether may allow you to submit content including civic questions, Agora posts, challenge submissions, and replication submissions ("User Content"). By submitting User Content, you represent and warrant that:

You retain ownership of your User Content. By submitting User Content, you grant Aether and its authorized operators a limited, non-exclusive license to display, process, and moderate that content as necessary to operate the platform.

7. Moderation and Platform Integrity

Aether reserves the right to review, moderate, remove, or restrict any User Content or account activity that, in Aether's or an authorized operator's reasonable judgment, violates these Terms, harms platform integrity, or creates legal or operational risk.

Moderation actions may include content removal, account restriction, or account suspension or termination. Where technically feasible, significant moderation actions are logged in the provenance ledger for transparency. Moderation is not guaranteed to be exhaustive or immediate.

Aether does not pre-screen all User Content and does not assume responsibility for User Content posted by others.

8. Intellectual Property and Reservation of Rights

The Aether platform, codebase, BCM framework, scoring methodology, and all associated materials are proprietary and protected by applicable intellectual property laws. All rights not expressly granted are reserved.

You may share and reference the civic analyses you generate using the platform for educational, informational, and journalistic purposes. You may not reproduce the platform software, BCM framework specifications, or scoring methodology documentation without written authorization.

9. No Advisory Relationship

Use of Aether does not create any professional, advisory, or fiduciary relationship between you and Aether or its operators. Nothing in the platform or its outputs constitutes legal advice, investment advice, medical advice, or any other professional guidance. Always consult a qualified professional for decisions in these domains.

10. Account Suspension and Termination

Aether or an authorized operator may suspend or terminate your account, with or without notice, for material or repeated violation of these Terms, conduct that endangers the platform or other users, or at Aether's or the operator's reasonable discretion for operational reasons.

Termination does not relieve you of any obligations incurred before termination. Sections 5, 8, 12, 13, and 15 survive termination.

11. Account Deletion

You may delete all locally stored Aether data at any time using the in-app deletion flow:

Profile → Settings → Delete All Local Data → Confirm

This action is immediate and permanent. The app returns to its initial state.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Aether and its operators, directors, employees, and licensors shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of data, revenue, goodwill, or profits, arising from or relating to your use of or inability to use the platform, even if advised of the possibility of such damages.

In jurisdictions that do not allow exclusion of certain damages, Aether's liability is limited to the fullest extent permitted by law.

13. Disclaimer of Warranties

Aether is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, completeness, or non-infringement. Aether does not warrant that the platform will be uninterrupted, error-free, or free of harmful components.

14. Changes to These Terms

Aether may update these Terms from time to time. Material changes will be reflected by an updated effective date. For significant changes, Aether will provide in-app notice where technically feasible. Continued use of the platform after changes constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, stop using the platform.

15. Governing Law and Dispute Resolution

Pending legal review: The governing-law jurisdiction and venue for dispute resolution are pending review and selection by legal counsel. This section will be completed prior to final public deployment. The placeholder below is intentional and does not constitute a legal commitment.

These Terms will be governed by and construed in accordance with the laws of [jurisdiction — to be confirmed by counsel], without regard to conflict-of-law principles. Any dispute arising from these Terms or use of the platform will be subject to the exclusive jurisdiction of the courts of [venue — to be confirmed by counsel].

16. Intellectual Property Complaints

If you believe that content available through Aether infringes your copyright or other intellectual property rights, send a written notice to support@aether-civic.app that includes:

Aether will review properly submitted notices and take appropriate action in accordance with applicable law. Repeat infringers may have their accounts terminated.
